摘要
教育法的价值目标是教育法律效果预先的观念模型和超前反映,是指导教育法创制和实施的基本原则。教育法的价值目标包括教育效能、教育自由、教育公平、教育效率、教育秩序。其中,促进人的自由而全面的发展是教育法的核心目标。提出教育法的价值目标有利于强化法律手段在教育改革中的作用、改善教育法制现状、改进教育现实。教育法价值目标实现的关键环节是加强和完善教育立法,把抽象的价值目标具体化为可操作性的法律条文。
The value orientation of education law is a prior conceptual model and reflection of its legal effect, and is the basic guiding principle of education legislation and law enforcement. The value orientation of education law comprises education effectiveness, freedom of education, education equity, education efficiency and orders in education. Promoting human＇s free and all-around development is the core objective of education law. Giving a clear statement about the value orientation of education law can strengthen the effect of legal measures in education reform, and can help improve the educational legal system and the reality of education. The strengthening and improving education legislation to translate key point of realizing the value orientation of education law is abstract law values into applicable legal provisions.
