行政法视野下小肥羊商标案的重新审视——一个实质法治视角的理论分析

摘要 从"小肥羊"商标案判决理由出发,从三个层次对该案作出考量:从形式法治的角度对案件争点进行考量;从实质法治为研究路径对多元化利益主体的救济机制进行构建;最后运用价值衡量方法从政策与策略层面寻找最有效的管制工具,以期实现商标产权界定领域依法行政与最佳行政的最优互动,从而获得更为公平也更有效率的司法和社会结果。 Starting from the judgment reason of Little Sheep brand case, considerations are made about the case from three levels:from the angle of the form of the rule of law case issues for consideration; from the essence of the rule of law as the research path to build diversified benefit main body of the relief mechanism; finally using value method from the aspects of policy and strategy to find the most effective control tool, in order to implement trademark property rights defining the best administrative administration according to law and in the field of optimal interaction, thereby gaining more fair and more effective legal and social results.
