我国农村土地流转的法律制度问题探析

Research on the Legal System of Land Circulation in Rural Areas of China

我国农村土地流转的法律体系中诸多规定过于笼统,相关程序也缺乏可操作性,导致许多地方在实践中出现了众多问题。简析造成这些问题的原因,提出农村土地流转法律制度改革完善的具体措施:加强立法;明确政府职责;完善农村土地承包经营权抵押制度,及强化土地流转过程中的税收立法等。

The law system for the circulation of rural land is too general in China and difficult for applying, which causes many problems in some regions. What causes these problems is analysed simply and then some specific measures are put forward to perfect the law system for the circulation of rural land as follows ： to strengthen legislation ; to clarify the function of the government ; to improve the mortgage system for the right to the rural land contractual management;and to strengthen the tax legislation in the circulation of rural land.
