略论孟德斯鸠社会理论中的法律思想——兼谈启蒙思想与理性法律观的建立

与其他启蒙时代思想家相比 ,孟德斯鸠接受了知识论思想传统 ,具有鲜明的理性主义法律意识。他的法律见解建立在他的社会理论基础上 ,即法律本质上是事物之间的普遍联系。所以 ,法律与社会存在密切关系 ,社会中某些因素的变化 ,则是法律变化的根源 ;法律变化也会引起社会变化。人类可以通过自己的理性认识社会和法律的性质 。

In comparison with other thinkers in the enlightenment age,Charles Louis Mondesquieu has accepted the ideological tradition with a distinctive legal sense of rationslism.His legal theory is based on his social theory.He believes that law is substantially a general connection among the things,therefore there's a close relation between law and society.The change of certain factors in the society is roots which make law vary;The variation of law can also let society vary.Mankind can make law meet the demand of justice by means of their rationality that they're able to understand the quality of society and law.
