论软法视阈下的现代大学章程建设

Modern University Articles of Association:From the Perspective of Soft Law

软法是伴随着公域治理模式的转型而出现的一种法规范,在当代大学治理逐步转向以民主参与机制为基础的开放服务型模式的过程中,以大学章程为核心的大学软法体系能够适应社会主义市场经济的要求和高等教育管理运行机制的现实期盼,是建立现代大学制度的内在要求。文章从软法的视角,分析了大学章程的性质,指出其作为大学自治的"宪章"具备软法的基本特征,并从软法的价值维度,分析了我国大学章程的建设路径。

Soft law is a norms that appear in the transformation of the model of public governance. When universities are switching to the open service model on the basis of democratic participation, it is imperative that the university soft law system, with university articles of association at the core, should suit the requirements of the socialist market economy, abide by the state policies of higher education, and fit into the operating mechanism of a modern university. This paper analyzes the properties of university articles of association from the perspective of soft law, and points out that the university articles of association, functioning as the charter for the autonomy of a university, have the basic features of soft law. Taking in view of the value dimension of soft law, it further looks into some approaches of building university articles of association.
