合同行政监管的新思考——评述《合同法》第127条的法律意义

文章认为在我国市场经济刚起步的条件下对合同的行政监管仍是十分必要的。对合同的行政监管并不是对合同当事人意思自治的否定 ,而是通过对合同的行政监管以更好地发挥合同在市场经济活动中的作用。

The writer of the article observes that the administrative supervision and control over contracts are still indispensable at the primitive stage of the market-oriented economy. Nevertheless, the administrative supervision and control over contracts do not mean denying the autonomy of the will of the contracting liability parties.
