摘要
近年来英国行政裁判所的改革主要集中在组织体系和程序规则领域。组织体系方面,行政裁判所已经成为独立的司法裁判机构,将无序的各类裁判所纳入到新的两级管理体系当中;审判人员的选任也在专业性的基础上排除了行政权的干预。程序规则由新设立的行政裁判所程序委员会统一制定,按照司法化模式设计,在保证公正性的前提下尽量简化,以便于相对人的使用。组织体系和程序规则的变革有利于行政争议解决的独立性、专业性和公正性。
In recent years, the reform of Britain' s administrative tribunals mainly focused on fields of the organizational system and the procedure rule. In terms of the organizational system, the administrative tribunal has become an independent judicial adjudication institution, bringing various disordered tribunals into the new two-layer management system; the intervention of administrative power in the appointment of adjudicatory personnel has been excluded on professional basis as well. Procedure rules are uniformly formulated by the newly established Administrative Tribunal Program Committee, which are designed according to the judicialization mode and simplified as much as possible on the premise of impartiality maintenance for the usage convenience of the counterparts. These changes in the organizational system and procedure rules contribute to the independence, professionalization and impartiality of administrative dispute resolution.
