关于“海上损失”分类的辩证研究

Dialectical Analysis on Classification of ＂Marine Loss＂

本文从我国海运保险的险别出发，对海运货物保险中关于海上损失的划分予以分析，提出海上损失的分类还应增加外来损失一类。而且，部分损失既可以按损失的性质分成共同海损和单独海损，也可以按损失的形式分成实物损失和费用损失，既保留了具有不同特征的施救费用和救助费用两个概念，又把二者都兼容到费用损失中，使得逻辑关系更加准确。

Based on our country＇ s marine insurance coverage, the paper analyses the classification of marine loss in marine cargo insurance and puts forward that the external loss should be added to the classification of marine loss. And according to the nature of the loss, partial loss can be divided into general average and parti- cular average and also be divided into physical loss and charges loss in the form of the loss. It will be more logi- cal to retain the two different concepts of rescue and salvage charges and make the two fees compatible to the charges loss.
