摘要
最高人民检察院出台的检务公开制度在基层检察院的执行过程中遇到了制定者始料未及的制约因素,使得制度的实际执行情况与其预期目标产生了偏差,进而产生了检务公开制度执行的"失灵"。"失灵"的制度并不必然是失败的制度。理想与现实之间保持一段适当的距离可以为制度在执行过程中的创新性探索提供必要的空间。上级制度制定者对待制度"失灵"的态度则根据其整体社会效果而定,因此,制度"失灵"很可能成为制度进化的试验田。如果制度的"失灵"总能产生积极的社会效果,那么这个方案就很可能获得上级制度制定者的认可,并最终可能以制度或法律的形式固定下来,进而实现了制度的进化。
The openness of procuratorial work system issued by the Supreme People's Procuratorate encounters unexpected con- straints in its implementation by grassroots procuratorates, which produces some deviation between the practical implementation of the system and its expected goal, resulting in the "dysfunction" of the openness of procuratorial work system. "Dysfunction" of the system does not necessarily mean the system is a total failure. Maintaining a suitable distance between the ideal and the reality can provide the necessary space for innovative exploration during the system execution. Top system makers' attitude towards the "dysfunction" of the system depends on its overall social effects. Therefore, the "dysfunction" is likely to become the test field of system evolution. If this system "dysfunction" brings about positive social effect, the scheme is likely to gain recognition of top system makers, and eventually may come to stay in the form of system or law, thus system evolution is realized.
