论我国信访制度的现状及其完善

The Status Quo and Future Perfection of Petition System in China

信访制度作为一项特殊的救济制度,是公民政治参与和民意表达的重要渠道,但现实运行中信访制度自身存在着诸如功能错位、工作部门职责不清、重"人治"轻"法治"等问题,针对此,通过对信访现状存在诸多问题的原因分析,提出了从信访立法、完善信访监督体系及相应信访代理制度的建立等方面来完善我国信访制度的建议,其对于完善我国利益表达机制及缓和社会矛盾,维护社会稳定有着积极的作用。

As a special relief system, petition system is an important channel for citizen to participate in politics and to express their opinions. However, there are still problems in the present petition system, such as： dislocation of function and responsibility among departments, stress on ＂rule of men＂ rather than ＂rule of law＂. This paper analy- zes the causes of those problems and suggests that legislation and supervision system be improved and petition agen- cy system be established so that the petition system can be perfected. We hope these suggestions contribute to the development of interest - expressing mechanism, to the prevention of social conflicts, and to maintenance of social stability.
