摘要
国家具有管制公务员职务外行为的合法性和正当性,各国的从政道德法都明确规定了刑法上犯罪行为、不当行为、不名誉行为、损及职务上信任行为四类行为予以不同程度的管制和惩罚。鉴于我国当前反腐形势,以及公务员立法的完善,应借鉴他国经验,立法明确国家管制职务外行为的范围,并采取德国"损及职务上信任"的惩戒标准。
A country has the right to contro[ and punish the civil servants for their behaviors outside duties. All countries have clearly specified damage on the position of trust, criminal behavior, improper behavior, dishonorable behavior and four kinds of control and punishment to different degrees for the above behaviors. In view of the current anti-corruption situation and the perfection of the civil servant legislation, we should draw lessons from foreign experience, make law to specify the control of behaviors outside the scope of duties, and adopt German disciplinary standard "damage on the position of trust".
