《合同法》:立法国际化与本土化的统一

Contract Law: Harmonization of International and Localization in Terms of Legislation

该文从全球化的视野出发，通过对《合同法》与《联合国国际货物销售合同公约》及《国际商事合同通则》的比较，阐明《合同法》一方面借鉴、吸收和移植了两者的成果，反映了立法国际趋同化的需要；另一方面它又根据中国的实际情况，保持了本土化的性格。

This paper deals with the Contract Law from a view of globalization. By comparing the Contract Law with both the UN Convention on Contracts for the International Sale of Goods and the Principles of International Commercial Contracts, this paper reveals that, on the one hand the Contract ho reflects the need of international integration of legislation, and at the same time it has absorbed and transplanted their essence. On the other hand, the Contract Law retains the Chinese characteristics on the basis of China's practical situation.
