The Legal Mechanism of the High-tech Industry Intellectual Property System in China

文章阐析了高技术产业有关知识产权法律制度具备和应当具备的主要法律机制：促进、引导、平衡和保护机制，并以此为树引，针对我国现行知识产权法律在促进、引导、平衡及保护高技术产业发展方面的不足，提出了若干立法建议。由于高技术产业的孕育和发展对专利法和著作权法的依赖性最强，该文的剖析主要以这两个领域为基础。

This paper analyzes the mechanism of promoting, guiding, balancing and protecting of the intellectual property system in the high-tech industry. With such guidelines, certain legislative proposals, which aim at improving the intellectual property system in high-tech industry in China, are put forward. The focuss is on the patent law and copyright law that the breeding and development of high-tech industry heavily relies on.
