摘要
新《刑事诉讼法》第57条第2款规定,在法庭审理过程中,对于证据合法性的证明发生困难时,侦查人员或其他人员可以出庭说明情况。由于侦查人员或其他人员出庭说明情况与证人出庭作证存在区别,因此,应当明确侦查人员或其他人员的范围、出庭说明情况的程序及法律责任等重要内容。
Clause 2 of Article 57 of Criminal Proceedings Law stipulates that in the court trial of illegal evidence, when there appears difficulty of proving the legitimacy of the evidence, investigators and related persons should appear in court for explanation. Because there is difference between investigators or related persons and witnesses, it is necessary to specify the range of investigators and related persons, extent of exolanation, obligations and so on.
