在实体法规范的表达未合理考虑证明责任分配的背景下,借鉴日本法上的要件事实论成为一种合适的选择。将该学说应用于我国侵权法上的动物致害责任的分析,通过重新解读法条之间的意义脉络,不仅可以避免规范说在解释方法上的缺陷所带来的不当分配的后果,而且也可以发现和反思法律规范在立法技术上所存在的不足。

When the expression of many substantive rules has not considered the problem of burden of proof, it is a suitable choice to use the Japanese Ultimate Facts Theory for reference. By applying this theory to the analysis of the animal＇s liability clauses of our tort law, and re-- interpret the context of significance among the legal rules, we can not only avoid the wrong allocation due to the shortcoming of the interpretation method of Norm theory, but also find and rethink the shortage of legislative technique of our legal rules.
