The Influence of Chinese Traditional Humanistic Spirit on the Construction of Modern Concept of Government by Law

中国传统人文精神崇尚权力,关注群体利益,注重道德教化,强调个人义务,忽视个人权利,难以产生自由、民主、平等、法律权威、保障人权等现代法治理念。我们必须抛弃中国传统人文精神中不利于法治理念生长的内容,全面吸收有利于法治理念生长的中国传统人文精神及西方人文精神,重构法治的精神基础,方能建立现代法治理念,实现法治中国梦。

Chinese traditional humanistic spirit, upholding power, focusing on collective interest and emphasizing individual obligation while ignoring personal rights, fails to guarantee liberty, democracy, equality and legal authori- ty, or safeguard the modern concept of law such as human rights. The unfavorable aspects in Chinese traditional hu- manistic spirit for the development of the modern concept of law must be discarded, and the favorable Chinese tradi- tional culture spirit and western humanistic spirit should be fully absorbed to reconstruct the spirit basis of law. Only in this way can the modern concept of law be constructed and Chinese dream of government by law be realized.
