论道德权利及与法律权利的关系

On Relation Between Moral Right and Law Right

权利是人类个体对社会的一种正当要求,以自然法为权利的基本属性看来,自然权利的产生是大势所趋,在各学派、学说思想发展史上,道德权利成为了自然权利中的必然要求,本文从自然法伊始,尝试为道德权利做出明确解释,并试图论述道德权利与法律权利两者的关系。

Right is a kind of legitimate demands of individual human being to the society. In the light of of natural law being the basic property of right, production of natural rights represent the general trend. In the development history of various schools and theories, moral rights have become an inevitable requirement of natural rights. From the natural law, this paper at empts to make clear explanation for the moral rights, and tries to discuss the relationship between moral rights and legal rights.
