日本医师会医师责任保险制度及其启示

Discussing the Physician Liability Insurance Program of the Japan Medical Association and enlightenment from it

日本医师会医师责任保险由日本医师会投保团体保险,医师将医疗纠纷委托给日本医师会组建的专业委员会来调查及界定责任,为医师提供了价格低廉、费率稳定、保障范围较充足的保障,建立了一个专业、高效的医疗纠纷解决机制。但存在程序不够公开,患者参与不足,保险覆盖面不广,预防功能不强等问题。日本经验给我国的启示是:应发挥医疗专业协会的作用,实施强制医疗责任保险,并注重医疗责任保险的预防功能。

In the Physician Liability Insurance Program of the Japan Medical Association （JMA）, doctors can leave medical disputes to the professional committees of JMA to investigate the case and define the responsibilities, which provides doctors a low cost, stable and wide-range insurance and professional, efficient and cheap settlement mechanism for medical disputes. But this system has some problems, such as unclear procedure,lack of patients＇ participation, limited coverage and prevention. Enlighten- ment from it was playing full role of medical professional association, implementing compulsory medical liability insurance, and paying attention to its prevention function.
