论环境立法中的法律移植问题

Transplantation of Law in Environmental Legislation

发展中国家的环境立法 ,主要是移植西方国家环境法。改革开放以来的立法实践表明 ,我国环境法制度主要是从西方国家移植而来。国际环境合作和国内环境法学者的研究 ,在这一过程中起了重要作用。法律移植后的最大问题是实施难的问题 ,主要是主体之间出现了利益冲突和文化冲突。因此 ,实现本土化的文化改造与价值重建 。

The way of environmental legislation in developing countries is mainly to transplant the environment law of western countries. It is the same in China since the government holds the policy of reform and opening. International cooperation and the study of Chinese environmental jurists play important roles in this process. One important problem is the beneficial and cultural conflict among different legal subjects after legal transplantation. And so, the cultural reform and value rebuild is a very important task in China.
