当前,网上仲裁的发展还处于初级阶段,存在很多的问题。面对当前的困局,应采取更加宽容的态度,完善相关法律和制度。对网上仲裁协议的"书面要求"做扩大解释;充分利用现代科技技术,完善网上仲裁程序,增加其安全性和可靠性;增加当事人或仲裁员的自由选择,以更灵活的方式确定网上仲裁地;对于法律适用问题的解决,应该更加注重当事人意思自治原则的应用;而仲裁裁决的执行方面,应采取符合国际商事仲裁发展趋势的态度,制定法规,使网上仲裁裁决的执行更加规范。
