在后冲突时代,"战后法"的提出使得战后责任从道德概念转化为一种法律责任,随着国际实践的发展,"国内特别法庭"和"民族和解"等新的战后责任形式的兴起,预示了战后责任机制建立的国家化和民族化趋势,这种趋势反应了实现过渡正义的民族化路径与法治化路径之间的博弈,解决该问题的关键在于把握和协调国际法治与法律文化传统两者的关系,同时,摆脱权力政治的影响也是建立和健全战后责任机制面临的主要任务。

In post-conflict ages, the rise of jus post bellum makes it possible to turn the moral judgement of post-war accountability into a legal concept. The flourishing forms of post-conflict accountability mechanism, such as natinoal special tribunal and national reconciliation, are illustrating the trend of nationalisation and localization of accountability mechanisms, which reflects the confliction between a rule of law path and a national one to the establishment of transitiona） justice. The central task to establish post-conflict accountability mechanism at present time is to reconcile the requirement of international rule of law and the need for respecting traditional legal cultures, and to withdraw adverse effects of power polities in order to clarify post-conflict accountabilities.
