摘要
中国古代法制史上,历朝历代的统治者都极为重视婚姻家庭关系,并通过"礼"、"令"、"律"等确认婚姻关系的合法化。其中,特别是婚姻关系成立的程序性要件和限制性条件的发展变化,及婚姻律法的不断刑法化,对我国现今的婚姻家庭生活仍具有一定的沿袭和影响。
In ancient Chinese legal history, rulers of dynasties attached great importance to marriage and family relations, and confirmed their legalization through ＂ceremony＂ , ＂order＂ , ＂law＂ , etc. Especially the development and changes of the procedural requirements and restrictive conditions in setting up marital relationship, and the continued criminalization of marital law still have a certain lineage and impact on our present marriage and family life.
