On the Application of the New Trade Mark Law

新商标法既总结和反映了此前的实践经验,又进行了一些创新性规定。结合商标民事审判实际,就新商标法有关条款的民事适用,尤其是针对实践中关注较多的诚实信用原则、驰名商标保护、商标使用行为的认定、民事侵权责任及在先使用的保护等问题进行探讨。

With summarizing and reflecting the previous judicial practice experience, the new Trade Mark Law also adds some innovative provisions in it. This paper mainly analyzes the practice of trademark trial and discusses the application of some provisions of the new Trade Mark Law, particularly focuses on the principle of good faith, the protection of famous trademark, the identification for trademark use, the civil liability for tort and the protection of the first user＇s right.
