“完全代孕”合理性与合法化问题探析

On Rationality and Legitimacy of "Full Surrogacy"

我国目前相关规范性文件对代孕实行完全禁止的政策,但实际效果不佳。而"完全代孕"具有适用的合理性与法理依据。我们应当加快立法步伐,单独制定一部《人工生殖技术管理法》或者《代孕管理法》,将"完全代孕"纳入法律规制范围;允许实施"完全代孕";明确规定其适用条件、代孕双方当事人的权利义务,核准登记机关及其权限以及纠纷的解决机制和救济途径等内容,使"完全代孕"合法化。

Now our country have related standardized documents to completely ban full surrogacy, however the real effect is not so good. While ＂full surrogacy＂ do have rationality and legal basis. We should speed up the pace of legislation, draft an Artificial Reproductive Technology Administrative Law or Surrogacy Arrangement Act separately, to put full surrogacy under the law, allow the implementation of full surrogacy, clarify its applicative conditions and the rights and obligations of both parties, determine the approval authority and its limits of power, provide the dispute-solving mechanism and relief approaches, to legalize full surrogacy.
