格式合同的产生和发展是20世纪合同法发展的主要标志之一。随着我国社会主义市场经济的迅速发展,格式合同以其自身的价值与特征被应用于旅游行业,促进了旅游业的繁荣与发展,但也带来一系列负面影响。本文从旅游格式合同的优点及弊端出发,结合我国关于格式合同的立法现状和旅游行业经营实践,重点探讨运用法律手段对旅游合同加以规制。

The emergence and development of model contract is one of the main signs in contract-law development in 1900. With the rapid improving of Chinese socialist market economy ,model contracts ,with its own value and charac-teristics, are applied in the tourism industry. While causing the boom and development of tourism, model contracts brought about series of negative effects.
