摘要
房屋拆迁补偿协议书乃民事合同,对此做出的行政复议决定书应为无效且对合同当事人不发生任何法律效力。2003年发生的国有土地使用权提前收回事宜,应适用国有土地使用权"相应补偿"之立法,其实质是对房屋及其他不动产的补偿,而土地使用权本身仅涉及土地出让金退还问题。补偿协议书中约定对房屋的充分补偿应视为是对土地使用权相应补偿权的行使。在对房屋充分补偿的前提下,再行主张对土地使用权的补偿,违反了"相应补偿"的立法意旨;主张对房屋占用范围以外的土地的补偿违反了土地在民法上的独立性。在国有土地使用权提前收回的情况下,并无"地随房走"原则之适用。
Agreement of the compensation for housing demolition is one of the civil contracts, so the ad- ministrative reconsideration decision made for that purpose should be considered invalid and poses no legal force to the contracting parties. In 2003, withdrawing the use right of state - owned land in advance should ap- ply to the legislation of "corresponding compensation". Its essence is to compensate for houses and the other real estates, while the land usage right itself only relates to returning of the land - transferring fees. The full compensation for house demolition which has been agreed in the compensation agreement should be regarded as exercising the corresponding compensation for land usage right. With the condition of full compensation, argu- ing for compensation of land usage right again is the violation of legislative intent on "corresponding compensa- tion"; furthermore, asserting compensation for the land outside the house breaks the independence of the land based on civil law. Consequently, in the premise of withdrawing the use right of state - owned land in ad- vance, there is no application of the principle of "land goes with the house".
