统筹城乡发展中的农村地区司法资源配置研究——以法官资源为主要对象

司法既是一种社会管理工具,也是一种社会服务手段。在实施统筹城乡发展的战略中,统筹城乡司法的发展既是统筹城乡发展应有的子课题,也是统筹城乡发展的法治保障。司法资源作为司法活动的必备条件和社会公共服务资源,其能否公平配置直接影响着统筹城乡发展的社会效果。针对以法官资源为代表的城乡司法资源配置的偏失,应当通过为农村地区弥补法官资源、适当下移上级法院优质法官资源、提高农村地区基层法官待遇等路径,优化和稳定农村地区法官资源,逐步缩小城乡法官资源"剪刀差",以促进城乡司法的统筹发展。

Justice is a social management tool and a social service means. In the implementation of co- ordination development strategy between urban and rural, the co-ordination justice development between urban and rural dose not only the sub-topics of co-ordination development between urban and rural, but also a law protection. As a prerequisite of judicial activities and public resources, whether judicial resources can allocate fairly or not will make some direct impacts on the social effects of co-ordination development between urban and rural. In view of partiality of judicial resources allocation represented by judges between urban and rural areas, we should optimize and stabilize judges resources in rural areas, through making up judges resources for rural areas, appropriately moving quality judges resources of the superior court down to grassroots courts, improving grassroots judge treatment in rural areas, gradually narrowing the judges resources ＂scissors＂ between urban and rural, to promote the co-ordination development between urban and rural justice.
