我国未成年人刑事案件社会调查制度运行模式分析

An Analysis of the Operating Mode of China's Social Investigation System of Juvenile's Delinquency

未成年人刑事案件社会调查制度是修改后的刑事诉讼法新确立的一项制度,是少年司法制度的重要组成部分,体现了国家监护和儿童特别保护的特殊理念。实践中各地司法机关也对涉罪未成年人社会调查的内容、程序以及配套制度等方面进行了积极的探索,积累了诸多经验,但各地的探索也因实施条件、方法等因素不同而使得实践结果呈现出多种模式。由于法律规定的概括性以及司法实践的多样性,有必要在对比各种模式做法的基础上,提出系统的法律规制思路与立法构想。

Abstract： Social investigation of juvenile＇s delinquency, a system established by the amended criminal procedural law is all important component of juvenile justice system, reflecting the idea of providing guardianship and protection for children. In practice, the judiciary organs all over the country are actively exploring the problems of the juveniles involved in crimes from the aspects such as investigation contents, pcocedares, supporting systems, etc. and have accumulated a lot of experiences. Owing to the diverse implementation conditions and methods in different places, the exploration results are showing a variety of modes. As the regulations in law are general, but the judicial practice is diverse, it is necessary to propose systematic ideas of legal regulations as well as legislative conceptions on the basis of the different modes.
