审查逮捕阶段讯问犯罪嫌疑人制度在民族地区实施问题初探

A Study on Interrogating Criminal Suspect System in the Investigation and Arrest Procedure in Ethnic Regions

实行审查逮捕阶段讯问犯罪嫌疑人制度,对深化民族地区检察权改革具有重要的现实意义。然而,民族地区特殊的主客观条件对该制度实施具有一定的制约和影响。因此,民族地区实行审查逮捕阶段讯问犯罪嫌疑人制度,应考虑到当地检察机关的工作实际,提高办案人员的认识水平,明确必须讯问犯罪嫌疑人的案件范围和讯问重点;加强办案人员的业务培训,提高讯问犯罪嫌疑人的业务素质和技能;注重实效,构建讯问犯罪嫌疑人的网络平台和听取特殊人员意见机制。

There exists practical meaning in deepening the reform of Tibetan procuratorial powers via the im- plementation of interrogating criminal suspects in the investigation and arrest procedure in Tibet. However, to a certain extent, the implementation of the system is affected by the unique objective conditions, the cognitive level and professional qualification of the investigators in Tibet. Thus, in order to make the system succeed in implementation in Tibet, it is necessary to take into account the actual working conditions of the prosecution, improve the cognitive capability of the staff and make the scope and the focus of the case clear. Besides, it is also important to try to strengthen the training of the investigators to improve their professional skills and qualities. Furthermore, the practical results should be stressed. A network platform of interrogating criminal suspects should be built and a mechanism of listening to the views of specialists should also be constructed.
