精神障碍患者到综合科诊治的潜在法律问题的探究及对策

Exploration and countermeasures of the potential legal problems for patients with mental disorder admitted to integrated department

本文主要探讨精神障碍患者到综合科诊治潜在的法律问题,提出管理对策,并对精神障碍伴或不伴有躯体病的患者到综合科诊治,可能引起的潜在的法律问题的原因进行分析和探讨。发现综合科在收治患者,约束保护和识别就诊患者心理行为问题及知情同意权、隐私权、人格受尊重权等方面可能存在的违反法律法规的问题和行为。因此精神障碍患者到综合科诊治时,相关医务人员应掌握良好的沟通技巧,注重对患者的心理和行为问题的识别,尊重患者和家属的各种权力,不得拒收或推诿属于诊疗范围内的精神障碍患者,严格执行各种法律、法规,提高患者的依从性,减少医患争议的发生。

To study the potential legal problems for patients with mental disorder who were admitted to integrated department and put forward the countermeasures, and to analyze and discuss the reasons for the potential legal problems for mental disorder patients with or without somatopathy who were admitted to integrated department. This study found that there might be some questions and behaviors of violation of laws and regulations during the behaviors of admitting patients, protective restraint, recognition of patient＇s mental and behavioral problems, patient＇s right of informed consent, privacy and respected personality. So when patients with mental disorder who were admitted to integrated department, the relative medical staff should grasp the good communication skills, pay attention to the recognition of patient＇s mental and behavioral problems, respect each authority of patient and family members, should not reject accepting or buckpassing patients with mental disorder, and should strictly implement each of laws and regulations, improve the patient＇s compliance and decrease the incidence of doctor-patient dispute.
