摘要
为了应对示范对象和适用范围上的拓展,新版联合国公共采购示范法设置和完善了社会经济政策优先制度,作为在通用性和灵活性之间的缓冲机制。鉴于社会经济政策概念的相对不确定性,它倾向于采取一种封闭式的立法方法,将社会经济政策的解释权委之于立法者而不是执法者手中,并在其实施中设置了透明度、定期评估等要求,以防止它在实践中被滥用,损及示范法所积极追求的目标。作为一个公共采购立法尚不完备的国家,我国对社会经济政策的制度设计存在着缺少程序支撑、回应性较弱等不足,对新版示范法中的社会经济政策优先制度加强研究和借鉴非常必要。
UNCITRAL Model Law on Public Procurement (2011) revised its rules on socio-economic policies to provide a buffer area for its universality. Given the uncertainty of the concept, UNCITRAL Model Law tends to put the interpreting power of what socio-economic policies are on the hands of national law-makers rather than those of law enforcement officers, and set up checks as transparency and review, etc. to forestall its misuses. With a fledgling public procurement legal system, China still lacks procedural and responsive legal rules to support its promotion of socio-economic policies in public procurement, thus drawing on the experiences of UNCITRAL is quite essential.
