摘要
目前,我国的集体劳动争议无论从数量上,还是从地区分布上都呈现出扩大的趋势。本文认为,我国集体劳动争议处理立法,无论国家层面的法律还是地方层面的法规和规章都对集体劳动争议的界定和处理程序没有太多的突破。这导致我国劳动法律存在对不同类型的集体劳动争议处理路径模糊,以及在处理过程中忽视劳资自治的问题。因此,我国应该在集体劳动争议处理立法方面对这两个弊端进行必要的完善。
Collective industrial conflict, increasing in amount and widening in geographical distribution, has become one of the most influential factors to labor relations system' s harmony. In this context China's legislation on collective labor disputes resolution has been largely unable to meet new demands brought by this transformation, indicated by the fact that both the law and concerning regulations still follow the outdated notion of collective labor dispute and its resolution raised by Regulations of the PRC on Enterprise Labor Disputes enacted in 1993, Labor Law of the PRC, and the Regulation of Collective Labor Contract enacted in 1995. The problem of this notion is that the definition of collective labor dispute is rather confused and the resolution process is dominated by the government. Legislation of collective labor dispute resolution in the future should improve both problems for the better construction of collective labor law system in China.
