我国海外私人投资保险制度的构建

Initial Probe to the Estabishment of Chinese Overseas Investment Insurance Scheme

海外私人投资保险制度为私人海外投资的政治风险提供政府保证 ,从而保护海外私人投资者的安全及其合法权益 ,随着我国海外私人投资的进一步发展 ,建立我国海外私人投资保险制度势在必行。本文认为我国目前可实行单边与多边并存的海外私人投资保险制度 ,但在过渡期后应实行双边制 ,同时设计了包括保险机构、承保条件、保险范围、保险期限和损失赔偿等具体内容的方案。

Overseas Private Investment Insurance Scheme provides governmental protection against political risks so as to ensure the overseas investors’ security and legal interest.As the development of China’s overseas private investment goes,it is absolutely necessary to establish Chinese Overseas Private Investment Insurance System.This article holds that the curent Chinese Overseas Private Investment Insurance Scheme may adopt both the unilateral and the multilateral systems.Only after the transition period can we eventually exercise bilateral system.Meanwhile in this article the author has designed plans concerning such specific contents as insurance organization,insurance conditions and insurance coverage.\;
