立法法理学探析

An Analysis of Legisprudence

立法法理学是针对传统司法法理学而提出的研究立法的新的理论进路,法律及其与政治的关系是理解立法法理学内在逻辑的核心链条。自由是立法法理学的微观基础,政治的环境则是其宏观背景。立法法理学应当在实践哲学的框架内进行把握,即一方面要重视实践理性在立法过程中的作用,使立法者遵循立法法理学的原则、遵守立法者的义务;另一方面则要认识到德性标准在选举立法者中的重要地位,重视立法者自身德性的培养,特别是立法智慧的培养。前者是"规则主义"的立法法理学,后者则是德性主义的立法法理学,二者共同构成立法法理学的完整图貌,不可偏废其一。

Contraposed to traditional jurisprudence, legisprudence is a new theoretical approach to the research of leg- islation, and law and its relation to politics is the nucleus chain to understand the internal logic of legisprudence. Freedom is the micro basis of legisprudence and the＂ circumstance of politics＂ is its macro context. Legisprudence should be grasped in the context of practical philosophy： on the one hand, we should emphasize the role of practical reason in the process of legislation, then make the legislator follow the principles of legisprudence and obey the duty of legislator; on the other hand, we should be clear the importance of virtue standard in electing legislators, and we should emphasize the cultivating of legislators＇virtue, especially the legislative wisdom. The former is rule - centered legisprudence, while the latter a virtue - centered version. Either version should be ignored,because the two make up the whole picture of the domain of legispru- dence.
