摘要
该研究跳出国内类似选题仅从教学层面比较中外法律职业教育的研究思路,将中美法律职业教育比较纳入制度分析的框架,分别从教育的目标、体制、内容、方法和评估五个方面展开。中国法律职业教育成效不足的根本原因在于职业教育的核心制度要素的欠缺。强化中国法律职业教育的制度要素,应注重职业教育学位培养目标与效果的统一,职业教育与从业的挂钩,以及职业教育行政评估与职业协会评估的结合。
While most inland scholars do similar comparative study of the legal professional education only in the aspect of teaching, this research paper does a comparative study of Sino - US legal professional education from the aspect of institutional analysis, including: target, sys- tem, content, method and evaluation. After the comparative study, it's obvious to see that the root eanse of the poor legal professional education in China is due to the absence of key institutional dements. Therefore, the measures to perfect the institutional elements of Chinese legal profes- sional education consist of unifying the training goals and effects of academic degree, connecting professional education and employment, and combining the administrative evaluation and evaluation of professional association.
