社区戒毒协议的法律性质探析

The Legal Nature of Community Rehabilitation Protocol

社区戒毒是《中华人民共和国禁毒法》颁布后新增的戒毒制度,顺应了社区矫正理念的时代要求,对于调动社会力量一起致力于打击毒品违法行为,促使毒品成瘾者顺利回归社会,增强社区公民的法律意识和社会责任感具有重大意义。当下社区戒毒发展主要呈现出单一型和复合型两种模式的态势,两种不同发展模式之下的社区戒毒协议也因此具备了行政命令、行政合同和民事格式合同等不同的性质,而对协议法律性质的清晰界定是研究社区戒毒和完善社区戒毒制度的重要基础。

Community Rehabilitation is a new mode after Anti-Drug Law of People＇s Republic of China promulgated. It comply with the requirements of the idea of Community correction, This is of great significance to mobilize social forces to fight against drug illegal behavior, make drug addict smoothly to return the society, strengthen the community citizen＇s legal consciousness and the sense of social responsibility. The community rehabilitation development mainly presents two kinds of model of situation; different kinds of community reha- bilitation protocol have different legal nature like administrative order, administration contract and civil format contract. So to clearly define the legal nature of community rehabilitation protocol is the important foundation to the research of community rehabilitation and perfect community rehabilitation system.
