共犯理论在计算机网络犯罪中的困境及其解决方案

The Dilemma of Accomplice Theory in Computer Network Crimes and Its Solution

互联网的发展使网络共同犯罪行为中的意思联络和协作行为明显弱化,甚至出现了共犯关系消失的趋势。与此同时,共同犯罪故意要件的缺乏、网络犯罪帮助行为社会危害性的提高以及中国共同犯罪折中理论的缺陷等等,都使网络共同犯罪的认定与处罚变得困难。鉴于此,可以考虑把一些社会危害性极大的网络帮助和技术支持行为实行犯化,重新审视网络服务提供者行为的社会危害性,并引入共犯的限制从属性说,从而解决网络帮助行为的定罪问题。另外,通过对网络共同犯罪问题的讨论,进而也引起对中国犯罪论体系重构的反思。

The network development makes obvious weakening on the meaning contact and cooperation behavior in network joint crime acts,and even arises the disapperance of the accomplice relationship.At the same time,the absence of intentional elements of joint crime,improvement of social harmfulness for network crime helping behavior and lack of eclectic theory in China's joint crime make it difficult to determination and punishment of network joint crime.For this reason,we can consider making some behavior of network aiding and technical support as perpetrators,re-examine social harmfulness of network service providers and introduce limit subservience theory of accomplice,so as to solve the conviction problem of negative aiding behavior.Furthermore,the discussion on the problems of network joint crime causes introspection for the reconstruction of China's criminal theory system.
