摘要
我国《反不正当竞争法》规定了知名商品包装装潢权,但没有对知名商品特有包装装潢权利的归属做出认定,本次加多宝与广药集团的"红罐之争"凸显了该认定的重要性。本案的争议点集中于:一、涉案的知名商品是什么;二、涉案商品的特有包装装潢归谁所有?针对这些争议,宜采用在先使用和贡献原则作为认定知名商品包装装潢权利的判断标准,以弥补我国目前立法的缺陷。
China's "Anti-Unfair Competition Law"has stipulated the right of well-known commodities of packaging and decoration, but it fail to stipulate the ownership of packaging and decoration. And the "red tank battle" between JDB and GPHL highlight the importance of identification. The main dispute in this case : First, what is the well-known commodity ; Second, Who owns the unique packaging and decoration goods involved in the case? We should adopt the "prior use doctrine" and "principle of contribution to stipulate the ownership of packaging and decoration, so that we could cover shortcomings of current legislation.
