A Trial Discussion on the Legislation of Oil and Gas ——Using the real right attribute of oil and gas mining rights as the angle of view

在分析矿业权物权属性的基础上,提出吸收《物权法》的最新成果,突破现行矿产资源领域中某些与矿业权物权属性相排斥的法律规定,加快制定《石油天然气法》,促进我国石油天然气资源的合理开发、规范管理和有效保护。

Based on the analysis of mining rights＇ real right attribute, the article puts forward as follow： absorbing the latest achievements of the Law of Right over Things, breaking through legal regulations in the field of mineral resources being exclusionary to mining rights＇ real right attribute and accelerating the formulation of the Law of Oil and Gas so as to promote the rational development, normative management and effective protection of China＇s oil and gas resources.
