Analysis on the Legal Nature of the Mandatory Expense of Decontamination in China

以中国强制清污属于行政法律行为性质作为切入点,阐明强制清污行为属于海事行政强制执行方式中的代履行行为,进而提出强制清污费用的法律性质是具有行政法律性质的费用。

This paper starts with the analysis on the nature of mandatory decontamination in China, which is considered to be administrative law behav- iors, clarifies that mandatory decontamination belongs to the subrogation of per- formance in the maritime administrative enforcement methods, suggesting the mandatory expense of decontamination is by its legal nature concerned with ad- ministrative law.
