Research on the Natural Law of State Compensation

鉴于国家赔偿是一个历史的进程,其产生、发展及完善既有外在环境的影响,又有社会需求的催生,但更重要的是自然法思想的内在精神催生并引导了国家赔偿从无到有、从个案公平到社会正义的成长过程。采用历史研究的视角分析了自然法理论在不同时代、不同法学家思想上的体现,初步揭示了国家赔偿的合法性基础问题。

National compensation system is a historical process. Its emergence, development and improvement are influenced by both the external environment and social need. But it is more important that the inner spirit of natural law has guided the growth process of state compensation from nothing and from case fairness to social justice. In this paper, the theory of natural law embodied in different times and different jurist＇s ideas is analyzed from historical perspective, the legal foundation of state compensation is revealed.
