美国贸易法上的“332条款”初探

"332条款"是美国国际贸易委员会就关税和贸易态势进行"常规性事实调查"所应遵循的规范。"332条款"与反倾销、反补贴、保障措施、"337条款"和"301条款"等贸易措施有所不同。我国在出口贸易中需科学应对"332调查",也应尽快制定和颁行《产业竞争力调查规则》。

＂Section 332＂,known as ＂routine fact-finding＂ provisions of the United States trade law provides that any of the events on Tariffs and Trade may be investigated by USITC.It differs from provisions of Anti-dumping,Anti-subsidy,Provision 337 and 301.The paper gives some suggestions on how to deal with 332 investigation tactically and how to enhance the related rules in Chinese foreign trade law.
