摘要
随着我国市场经济法律体系的形成,食品安全方面的立法日臻完善。然而,我国食品安全执法机制却相对落后,集中表现在监管模式、执法理念、执法标准、执法保障、执法责任等方面存在较多问题,已成为我国食品安全事件频发的主要原因之一。我国已成立国家食品药品监督管理总局,整合食品安全监管职能。在食品安全执法中,监管部门要处理好高度独立、坚守职责、联合执法、公众参与、多元监督之间的关系,实现从运动执法、被动执法到常态执法、主动执法的转变,推进严刑峻法,强化信息公开和监管问责,走出食品安全监管的困境。
With the Chinese legal system for socialist market economy,the food-safety legislation in China is gradually perfected.The mechanism for the enforcement of food-safety law is,however,not matched up with,and becomes the principal culprit in the frequently occurred incidents of food unsafety.Recently,China has established its Food and Drug Administration to incorporate different food-safety watchdog functions.In law enforcement,the food-safety watchdog departments should,being independent and responsive,follow the model of combined law enforcement,public participation and multisectoral law enforcement,so that law enforcement may experience a transition from passivity to activity,and from emergency to normality.With stricter application of laws,information disclosure and accountability,food-safety supervision may be expected to go out of its present difficult position.
