摘要
抵押权与留置权的竞合是由同一财产成为不同法律关系的客体造成。关于这两种担保物权并存时谁优先受偿的问题 ,法律无明文规定。本文通过对学理上的两种观点进行分析比较 ,指出了各自存在的缺陷 ,从探寻抵押权与留置权的竞合的原因入手 ,找出了解决冲突的途径。
The coincidence between mortgage and lien is caused due to same property which become object of the different legal relationship.those vouch property right exist at same time for which person have priority that is not clearly stipulated by law,therefore,this article will discuss and analyse both kind types of vouch property right in order to find out imperfection each other through the two point view of theory.from researching reason for coincidence between mortgage and lien,to look to how to settle the way of conflict.
