摘要
劳动争议的解决涉及广大劳动者和用人单位的切身利益,维护和谐劳动关系是构建和谐社会的基石。现在我国经济体制领域已经产生了深刻变革,人们思想观念随之发生了深刻变化,社会各方面利益对抗加剧,劳动关系双方主体经济利益冲突愈演愈烈,构建和谐劳动关系任务艰巨。构建和维护和谐劳动关系,需要妥善处理大量出现的劳动争议。在现有劳动争议处理机制中调解是最有效化解劳动争议双方矛盾的方法,而劳动仲裁调解居于劳动争议解决核心地位。
The settlement of labor disputes concerns the vital interests of workers and employers, and maintaining good labor re- lations is the cornerstone for building a harmonious society. And with profound changes undergone in the field of economic system and in people's ideology in our country, interest confrontations in various sectors of society including the two parties of labor have become intensified. Therefore, it is an arduous task to handle properly a large number of labor disputes and to build and maintain harmonious labor relations. In the existing labor dispute settlement mechanism, mediation is the most effective method, and me- diation based on labor arbitration sits at the heart of labor dispute settlement.
