论《国际卫生条例(2005)》人权原则下的健康权

The right of health under the principle of human rights in the context of“International Health Regulations( 2005) ”

人权是指人因其为人而应该享有的权利。而作为自然人依法享有的保持身体机能正常和维护健康利益的健康权则在人权中自然占有重要的地位,其已成为国际政治体系的重要价值组成部分。《国际卫生条例(2005)》作为一部充分关注人权的国际法律文书,充分体现了对自然人健康权的尊重和维护。本文通过对人权、健康权等概念的介绍,对《国际卫生条例(2005)》框架下健康权的构建进行了研究和阐述,在对我国对公民健康权的保护及发展充分肯定的情况下,对健康权法律和制度的建设方面提出了新的希望。

Human rights are basic rights that all human beings are supposed to have equally. Under this principle, the right of health of which keep the body functionally normal and maintain healthy placed a crucial role among all hu- man rights. It has already become common value as an important part in the international political system. ＂Interna- tional Health Regulations （2005）＂, known as an international legal instrument that pays full attention to the human rights, shows all the respect and fully protection to the right of health for human being. In this paper, by introducing the concepts of human rights and the right of health, we analyze and elucidate the structure of right of health in the framework of the ＂International Health Regulations （2005） ＂. We put forward to the new hope in the improvement of the laws as well as regulations related to the right of health under the commendation of the protection and development of human health right by the Chinese government.
