图书馆文献传递与自助复印服务之版权问题研究——以加拿大CCH案为例

Intellectual Property Issues on Document Delivery Service and Self-service Photocopying in Libraries——Taking the Example of Canada CCH

本文从加拿大CCH案入手,探讨图书馆文献传递与自助复印服务所涉及的版权问题。对案件涉及的复制权、网络传播权、间接侵权、合理使用等问题进行分析。并提出加强图书馆相关业务的知识产权研究、出台图书馆版权管理方案,以及扩大法律对图书馆的豁免范畴等建议。

Taking the Canada CCH case as example, this paper diseu^ed the intellectual property issues on library docu- ment delivery service and self- service photocopying. Copying, the indirect infringement, the right to network dissemination of information, fair use and other issues were analyzed. Finally, some suggestions were given in order to improve the intellectual property management of library.
