摘要
本文以分包合同为研究对象,运用对比分析方法对国内外付款担保在分包合同中的应用进行对比,分析目前我国分包合同中付款担保存在的问题,提出在分包合同示范文本中推行工程付款担保制度的构想,为完善《建设工程施工专业分包合同(示范文本)》、《建设工程施工劳务分包合同(示范文本)》提出合理化建议.
In this paper, taking the subcontract as the research object, comparing the application of the subcontract from domestic and international payment guarantee by using the method of comparative analysis, analysing of the current problem of payment guarantee in the subcontract in our country, putting forward the idea of carrying out en- gineering payment guarantee system in the subcontract model text, making reasonable recommendations for improve the ＂Construction Engineering Professional Subcontract Contract（ model text）＂, ＂Construction Engineering Labor Subcontracting Contract（ model text）＂.
