在界定侵权损害赔偿范围时,可能由于侵害行为和损害后果间事实上因果关系的影响,造成赔偿范围无限扩大的可能性。为了将赔偿范围限定在合法的范围内,就必须先准确界定出侵害行为和损害事实间的法律上因果关系。通过研究台湾的一起绝育手术失败案例所引发的侵权损害赔偿诉求后不难发现,可预见规则的运用,对界定侵权行为和损害后果间的法律上因果关系,进而限定合法的赔偿范围,都发挥了重要作用,达到实质公平的要求。
