农民权益保护视角下的农村土地承包经营权法律保护研究

On Legislative Protection of the Contractual Right of Rural Land from the Perspective of Farmers' Interests

通过分析农村土地承包经营权的法律概念及其在我国的立法现状,从保护农民权益的角度出发,针对如何完善农村土地承包经营权,更好地维护农民的利益,提出对农村土地承包经营权进行相关立法,完善土地流转制度及征占补偿保障制度等合理性建议,以期能够为我国农村土地承包经营权更好的落实做出贡献。

This paper analyzes the legal concepts and the current legislative situation of the contractual right of rural land in China.It comes up with some rational suggestions aimed at improving the contractual right of rural land and ensuring the farmers’ interests from the perspective of protecting the farmers’ interests.It also suggests that we make laws of contractual right of rural land,improve the land circulation system and the security system of land acquisition and land occupation.
